Fighting Back the Right Way

If you've read my profile, you know why I'm here. My PASSION is to educate YOU, the victim, suspect or relative of such about the criminal justice system here in the United States and how it works. Not only do I have life experience from having been coerced, setup & threatened by career criminals that resulted in me finding myself a defendant, I am now pursuing my bachelor's degree in Criminal Justice. Once I obtain my AA degree, I will go back to the very same judge that convicted me, with all my proof & evidence, and show him I was not only a defendant but a victim as well. I will get my justice, the LEGAL way, on the system itself. If YOU ever find yourself being wrongfully accused of a crime, you were threatened to commit a crime or setup, you NEED to contact me. What if I refuse, but police search me anyway?

Know your rights. know that you can refuse to a search if the police does not have a search warrant. If they do have a warrant, don't panic...ask to see the warrant as you have a right to see it. I was arrested last year on an ILLEGAL search warrant, but didn't know at the time it was illegal. Know that the CA Penal Code states the warrant must be executed within 10 days of a judge's signature. My search warrant was executed about 20 days later. In a case as this, your attorney can file a motion to dismiss evidence against you. Watch out though...if you have a public defender, remember they work for the state, as does the DA, the police and the judge. If your attorney doesn't really fight for you, then you speak up in open court to the judge and state what the law says. Know your rights so you can protect yourself.

What if I refuse, but the police search me anyway?

You can refuse to be searched. If the police search you anyway, don't panic, know your rights, instead. If you refuse to be searched, tell your attorney. Beware though, if you have a public defender as they work for the state just as the cops & the judge do. I had proof that I was threatened & coerced under duress, but my attorneys didn't care because they work for the state. I even had a typed statement ready for court at my sentencing hearing and my public defender suggested I keep quiet. I now know he didn't want me to talk because his contract for the next year with the court may not have been renewed! However, if your attorney(s) don't really fight for you, that's when you talk to the judge in open court yourself and state the law.

Investigate who your leaders are

As you all know by now from reading my previous posts, I am EXTREMELY dissatisfied with the way the justice system works here in the United States. One of the things that really bothers me is what lawmakers, judges and attorneys can get away with. If you read my profile, you'll know when I got arrested last year, I had THREE different attorneys representing me on my case. What really get to me is my first attorney, who's running for judge and is a prominent attorney in Kings county, California, told me there's no such defense as the duress defense. I know for a fact this is not true due to the fact I talked personally to one of her colleagues who told me there is a precedence for this defense in a courtroom, plus, I researched it on the internet. I know I'm blessed for the fact I only got probation, but as a taxpayer and as someone who's now had the experience of being in the system, I now have first hand experience that tells me for a fact our justice system needs some fixing!

Absurd Laws

Hi! Have you heard about Arizona's new racial profiling law? This outrageous law forces the police to ask people for their citizenship papers based on any "reasonable suspicion" that they might be in the country unlawfully. And since the law never defines "reasonable suspicion," it's inviting a new wave of racial profiling.
We don't live in a country where people should be forced to "show papers" at almost any time -- just because of how they look, talk or dress. It's unconstitutional and un-American. Will the lawmakers stop at nothing??? I honestly thing the economy is soo bad that lawmakers are just lashing out to collect that ALMIGHTY dollar! This is one of the signs the Bible speaks of that tells us we are living in the end times, so watch out!

The Calcium Lie - What Your Doctor Doesn't Know Could Kill



I decided to publish this clip because I personally know a woman who actually overdosed on calcium simply because of the amount on the prescription label her doctor recommended. That same doctor shoved a prescription in my face for ear wax removal drops when I went to him, complaining of not being able to hear. He FAILED to do his job and look in my ear. I accepted the prescription. After three weeks when it didn't work, I went to a different doctor who did his job and actually pulled cotton out of my ear!

Getting Tricked or Intimidated by Police



I chose to put this clip on my blog because I was tricked by the police when they came to my house. At the time of my arrest, I had a family member that was away from home and I kept asking the police were they at my house because of him. I asked this question over & over with no response from the police. Then, I was coerced into confessing. These cops were smart...they used psychological coersion on me to get me to confess! Whenever you are faced with the cops saying you're under arrest, ALWAYS, ALWAYS say you want an attorney present!

Refusing Police Entry to Your Home



I chose to post this clip because I never knew the police had a search warrant when they came to my home. I innocently invited the police into my home for two reasons: 1) My dad was a cop & I used to provide cleaning services for my local police department, therefore, I trusted cops back then. 2) At the time of my arrest, one of my family members was away from home and I thought something was wrong, so I continually asked the cops were they at my house in regards to that family member. I thought something had happened to that family member & I was scared! Second piece of advice from me is to always confront police with a cool head. Never be emotional!

Making right of a wrongful conviction



After watching this clip, I put it on my blog because I met someone in jail who got sentenced to a 21 year prison term that is actually INNOCENT of what she was accused of. The scenario was this: The woman, her brother & cousin were at a night club sometime last April and got accused of assault by another female. They went to trial. The supposed victim had one tiny scratch on her and there was NO evidence on the night club video camera of an assault. The woman's cousin had NEVER been in trouble with the law before but got sentenced to 7 years in prison. My friend had been in the system as a juvenile, but had already paid the price for her past. The DA brought forth her past record & her own attorney told her that the DA bringing up her past, for which she already served time for, was ILLEGAL! How can the DA's office get away with this crap! Furthermore, how did the court allow it? This is not what our tax dollars are supposed to pay for! She is appealing, but my heart goes out to her, her brother & cousin. This is one of the prime reasons I started www.dont-bea-victim.com and this blog. Let's pray she wins her appeal.

American Injustice- Lies,Cover-Up's, Corruption,Texas Courts



In the title of this clip is the word "lies". Well, in my case last year, I was represented by public defenders. I know for a fact that any attorney that is licensed in California, where I live, is bound by a strict code of ethics. However, my first attorney lied to me and told me there was no such defense as the "defense of duress". Funny thing is, I got a free consultation from a private attorney who has worked with this particular attorney and he told me this defense does exist in our court system. I found out first hand this is why public defenders are called "public pretenders"!. Once again, don't be a VICTIM!

The American Criminal INJustice System



In my lifetime with what I've been through, I've learned the hard way that what the United States refers to as "freedom" comes at a price. Once you're grown and can leave the comfort and stability of your family home, you may go to college or work, but there are certain fees we all have to pay to stay "free". Once again, people, I was coerced & threatened. The people who got to me THREATENED to kill my children if I did not cooperate with them. I told my "public pretenders" this and they said it didn't matter. I even had threat letters that were mailed to me...still, I'm now a convicted felon. One of the men who got my address had already been serving a life sentence in prison. Maybe had the US spent more money on building a school that could address his issues, he wouldn't be behind bars, which ultimately led to his phychological coercion of me.

Fight your Doctor

My friend, Dave, had constant stomach pain for 1 year. His doctor continued to tell him there was nothing wrong with him, even though there was only ONE morning within that whole year my friend woke up with no stomach pain. Dave asked his doctor to do tests...the doctor refused. Dave asked for a referral to a specialist...he was refused. He even asked to see another doctor...well, of course, the doctor probably then felt betrayed, took it personally and refused Dave again. My point here is too many doctors try to play God, think they know everything and totally ignore the true need of their client. I personally had a doctor, now Chief of Staff at the clinic where I lived at that time, fail to do his job correctly when I complained of not being able to hear. He sent me home with ear wax removal drops without looking in my ear to find the problem. A month later after the drops failed to work, I went to another doctor and that doctor did his job correctly and found cotton stuck in my ear! This is not what we pay insurance premiums for! If you find yourself or a loved one in this position, you need my services! I will look up the codes, laws and your options for the county you live in and even visit your doctor with you!

My Jail Sistas

While I was in jail, I met several women there that did not deserve to be there. Two of them, very dear to my heart because they were actually defending another person, both got sentenced to prison. Irma, got in the middle of a fight between her adolescent son and the boy's father, but because the boy's father has connections in the community & his ill feelings toward the boy's mother, was able to pay an attorney & got Irma sent to prison. Another one, Cindy, got into a physical fight with a woman who kicked her daughter-in-law in the stomach while in her last month of pregnancy. Cindy was trying to protect her unborn grandchild, but she's the one who got put in jail, while the attacker went free. I met and lived with both of these women while I was in jail and they both have a heart of gold. I have children myself, and would really hurt anyone who tried to hurt either one of my kids. So, if you EVER find yourself in a similar position, you really need to hire me to help you! I'm starting school in the fall for Criminal Justice, so I'll know both sides of the system. Plus, I will look up statutes, laws and codes for the county you live in. Furthermore, if applicable, I will come to court with you to help you fight for your rights!

The Innocent Stand Accused

An associate of mine, Terry White, from facebook's, LawForum, writes, "A person is wrongfully charged with grand larceny in 2004, even though the authorities KNOW that NONE of the elements of the crime even apply to the person they are charging. Even so, the court is ok with this and in Feb. 2005 offer to send this person to prison for 3 years. Of course this person asks for a jury trial. Noone hears ANYTHING for 3 1/2 years when a trial date is set, well past the 18 month deadline to set a trial date in this particular state which I think should be illegal to begin with. Then, this person's attorney who was paid in full as of 2005, drops the client because they cannot find them rather than file a motion citing the speedy trial laws. So then in 2009, another trial date is set for the now lawyerless person, who, of course does not get any notice. A bench warrant is served. Isn't this completely illegal for a court to blatantly disregard the laws of the state and continue harassing this person? How does one go about resolving this issue short of turning themselves in to the corrupt legal system and going to prison? This person would be throwing themselves to the wolves!Who would one go to? How do you fight the corrupt practices of the court?".

Once again, this is an example of the seriously corrupt legal system here in the United States. This is definetely NOT justice, this is INJUSTICE.

Shocker

Hi. My name is Patricia Bennett. I'm a 43-yr young divorced mother of two teenagers. About 3 years ago, I was emotionally distraught due to some serious personal family issues. As a result, I was coerced & threatened into committing a crime by career criminals, who I believe know my ex-fiance, who did time in Corcoran State Prison. These career criminals threatened to kill my children & I. I was told not to go to the police as I was being watched. I was really scared and gave in to the threats. When I got caught, I was arrested on an ILLEGAL search warrant, psychologically coerced into confessing by the authorities without an attorney & not read my rights. Then, I was told by my first public defender there was no such defense as the defense of duress, after I'd researched it myself! My second public defender, along with my first public defender told me that me NOT being read my rights did not matter, even though I know the Supreme court ruled not Mirandizing a suspect unconstitutional! My third public defender pressured me into "pleading out" (this means to plead guilty) because he told me if we went to trial there was a good chance we'd loose and the DA wanted to send me to prison for two years, but I was facing up to 6 years. On top of this, at my sentencing hearing, I asked my attorney if I could make a statement to the judge & he advised against it. I told all my attorneys I had proof but they would not listen to me and really fight for me.
